Terms and Conditions: Kens Driving School

 

These Terms and Conditions are an important part of your driving tuition

 

Ken Taylor is the proprietor and representative of Ken’s Driving School

 

By taking/booking driving lessons with Ken's Driving School it is accepted that you have read and agreed to these terms and conditions.

 

Implementations after Covid-19:

> I will follow the industry best practice on PPE depending on requirements for every lesson.

> I Will implement best practices to reduce viral contamination for a safe driving lesson.

> Every pupil upon taking a lesson has confirmed that they and their household are symptom-free. 

> I hold no responsibility for the loss in driving availability during the Covid lockdown due to being unable to provide lessons.

 

Be fit to drive

Upon booking and taking a driving lesson you have confirmed you and your household are symptom-free of Covid-19. Washing your hands prior to a lesson is the best practice and highly advised.

 

You must hold a current and valid driving licence which must be produced on your first driving lesson and at regular intervals throughout your training. Any changes to your driving licence due to medical conditions or driving convictions must be communicated to me immediately. It is also important to attend lessons with any appropriate glasses or contact lenses for reasons of road safety. If I think you are unfit to drive for failing to meet any of the above conditions the lesson will be cancelled at your expense. I cannot accept responsibility for any injury, loss or damage arising from a driving lesson. Be aware that prescribed drugs will affect you’re driving.

 

If I feel that you are unfit to drive through drink or drugs I have testing equipment in the form of a breathalyser and swab testing kit located within the car. If requested you are required to be tested, if positive readings are obtained the lesson will be cancelled and still chargeable. If you refuse to take the test it will be cancelled and still chargeable. 

 

Punctuality

I will try to contact you if I am going to be later than 5 minutes for your driving lesson. The time lost will be added to the end of the lesson if possible or added to another lesson at a later date. If you are late for your lesson, then that time will be lost. On arrival for your lesson, I will wait 10 minutes outside your property. If after this time you have not responded to any messages i may have sent or have not seen me outside of the arranged pick up point then this lesson will be charged at the full rate.

 

Insurance

All fees include student cover whilst driving the registered vehicle under the direction of a driving standards agency ADi/PDi/ (car) or on a driving test with an approved DSA examiner(s).

 

Pupil Cancellations

If less than 24 hours (1 day) notice is given to cancel or request to reschedule a scheduled driving lesson or multiple cancellations in the same week the full lesson fee must be paid. If you suspend taking your driving lessons without agreement within a block of prepaid lessons for a period of 8 weeks (2 months) or more or I haven't heard off you during this period any remaining lessons will be forfeited. This includes intensive courses. If you cancel driving tuition any prepaid lessons outstanding are subject to a cancellation/administration fee of 50% of the remaining amount. All cancellations must be made with a phone call or text message that I have received/read.  Refunds will be given via bank transfers only and will have to go through my accountant which can take upto four weeks. If cancelling a block of lessons any discounts are on the understanding of using all the hours offered. By cancellling the block booking early the used hours will be calculated/charged by individual hourly rates and the outstanding balance is calculated out using this method. 

Note: in special circumstances, my discretion may be used.

 

Ken’s Driving School Cancellations

All bookings are made on the understanding that Kens Driving School is not responsible for the postponement or cancellation of training due to exceptional circumstances such as traffic/weather conditions mechanical breakdown of equipment, tutor illness or any other cause outside of my control.

 

Test Cancellation

I cannot be held responsible for any mechanical or electrical failure which may cause the prevention or termination of a driving test and any costs occurred. I also cannot be responsible if the DSA cancel the test due to weather or strike action or for any other reason.

 

Practical Test

I will make every effort to help you reach a good standard of driving that will enable you to pass your driving test, you must try to maintain regular lessons leading up to your test otherwise your test date might have to be moved to give you more time to prepare.  The only way to pass the driving test is to be properly prepared.  In the interest of road safety I reserve the right to withdraw the use of my car and my services for tests without prior notice, should you prove to be unsafe and not up to test standard, this includes intensive courses. 

 

Penalties

Whenever you are driving in the school vehicle, you will be under close supervision. However, Ken’s Driving School cannot be held responsible for any infringement of the law. Any fines/points that are incurred will be the responsibility of the driver.

 

Intensive driving courses

These courses are not a guaranteed pass, this would just be misleading. The course is up to 50 hours of one on one driving instruction and includes the driving test booking and test fee. it does not cover the theory test. It will be with a mutual agreement as to when these hours will be used to fit around my current workload and the student’s availability. Payment must be paid in full prior to starting the course. Any outstanding hours remaining once passed must be used within 4 weeks on ether motorway experience or familiarisation of your own car otherwise the remaining hours are forfited


If for any reason I feel the pupil has not reached the required level to complete a driving test safely due to missing lessons or has not just picked it up as expected then the remaining hours will be used as normal lessons but the test will be forfeited. 

 

The intensive course is only valid for 12 months, all hours must be used within this period. After 12 months the course is no longer valid and all outstanding hours/test will be cancelled with no refunds.

During the course, the same rules apply as per these terms and conditions.

 

if you start the intensive course and for any reason you don't have a lesson for a period of two months or more without consulting with myself with a valid reason the course will be forfeited and outstanding monies/lessons will be lost. 

 

Payments

I accept payment by cash/cheque or bank transfer. Payments should be made at the start or end of a lesson.

 

Practical driving test

Kens Driving School reserves the right to withhold the training vehicle if I deem that the student has not reached the required standard to drive without tutor supervision. Ken’s Driving School cannot be held responsible for test appointments being postponed or cancelled by the DSA or the student has given Ken’s Driving School the incorrect details of the test. If the test has been cancelled on route or at the time of arrival at the test centre then payment is still due for time scheduled

 

Personal property

Kens Driving School accepts no liability for personal property that is left in the vehicle. Any items found will be retained for you to collect.

 

Mobile phones and electrical devices

All students should ensure that mobile phones and electrical devices unless agreed otherwise are to be switched off/left at home prior to your driving lesson for safety reasons.

 

Holidays and Availability

I will give you notice of holidays or days where I am unavailable. Please ensure that you do likewise.  Please be sure to book your first lesson after your holiday or break in tuition, to retain your place on the diary and to maintain progress.

 

Complaints

Should be made in the first instance to Ken’s Driving School. Failing agreement or settlement of a dispute, reference may be made to DVSA’s Registrar of Approved Driving Instructors who will consider the matter and advise accordingly. Should the Registrar not be able to settle the dispute he or she may set up a panel, with representatives from the ADI industry, to consider the matter further or advise that the matter should be referred to the courts or other statutory body to be determined
